Procuring a child under the age of 13 years under section 204B Criminal Code WA
Our client was charged with 6 counts of using electronic communication with an intent to procure and expose a person under the age of 13 to engage in sexual conduct. Our client denied the charges, as he stated that he never believed the person in question was really under the age of 13, and actually believed she was over the age of 18. We assisted our client to prove his claim of innocence in the District Court where a Jury unanimously found him Not Guilty of all the charges.
Sexual Assault under section 326 Criminal Code WA
Our client was charged with aggravated sexual penetration without consent. Our client denied the charges and claimed that it was consensual. They were in a relationship and there were inconsistencies in the alleged victim’s story which supported our client’s version of events. We assisted our client to prove his claim of innocence in the District Court where a Jury unanimously found him Not Guilty of all the charges.
Stealing under section 378 Criminal Code WA
Our client was charged with stealing. We assisted our client with his plea in mitigation to the Court which resulted in him receiving the minimum mandatory sentence, after taking into account his life experiences (previous drug addiction), current situation (partner suffering post natal depression) and previous offences.
